Fmcampus.eu (and its sub-domains, hereinafter all collectively referred to as “F-M Campus”) is an Internet platform of the Internet website of Federal-Mogul Global Aftermarket EMEA, BVBA, Prins Boudewijnlaan 5, 2550 Kontich, Belgium (hereinafter also referred to as the “Federal-Mogul”).
Federal-Mogul collects personal data from users at various points on F-M Campus and its sub-domains. The following is Data Privacy Statement explains which data are required and how you can enter other optional data for added benefit.
You can use the F-M Campus without registration or login to the extend functions are available. However, certain services offered on F-M Campus (e.g. training and your personal score page) can only be accessed and used after registration, acceptance of term and conditions as well as login.
With the visit of F-M Campus, Federal-Mogul´s web server collects general technical information for operation of the website, specifically those about the software and hardware you use, the IP address, specific time and duration of your stay, and which pages of the website you visit. Google will also transfer the aforementioned information to third parties, if this is required by law or if external service providers handle the said information assessment. General Terms and Conditions for the use of F-M Campus
Federal-Mogul Global Aftermarket EMEA, BVBA, Prins Boudewijnlaan 5, 2550 Kontich, Belgium (hereinafter also referred to as the “Federal-Mogul”) offers its customers availment of the online service F-M Campus, which enables Federal-Mogul customers online access to this technical portal (hereinafter referred to as “F-M Campus).
1. Sphere of application
1.1 The general terms and conditions described in the following (hereinafter referred to as the “General Terms and Conditions”) shall apply for the use of F-M Campus.
1.2 The use of F-M Campus is only available to Federal-Mogul customers in accordance with the stipulation of the following provisions.
2. Registration and access to F-M Campus
2.1 The prerequisite for the use of F-M Campus is successful registration of the Federal-Mogul customer concerned.
2.2 For the purpose of registration, the customer shall send an online query to Federal-Mogul by inserting requested data necessary for registration into the logon screen and checking completeness and correctness. Before sending the online query, the customer shall accept the General Terms and Conditions.
2.3 The customer will be notified via e-mail of successful registration, sent to e-mail address submitted by customer. After successful registration for F-M Campus, the user shall receive personal F-M Campus access data.
2.4 Access to F-M Campus takes place online via the F-M Campus website or via a direct link provided by Federal-Mogul. To login, user must insert its personal access data into the fields envisaged on the logon screen.
2.5 Access to F-M Campus is free of charge. However possibly costs may be incurred for general access to the Internet, which shall be borne by the user.
2.6 There is no claim to registration for F-M Campus. Federal-Mogul reserves the right to refuse or reject registration for F-M Campus at any time, at its sole discretion and without stating any reasons.
2.7 It is possible for users with the aid of his personal access data to inspect or modify his data.
2.8 The user can, at anytime, request deletion of its F-M Campus access in writing or via e-mail.
3. F-M Campus’s scope of service
3.1 F-M Campus provides the users with comprehensive information about its technical services, news & trainings.
3.2 Federal-Mogul makes every effort to constantly optimise and adapt the offer of information within F-M Campus. Due to its limited capacity and clearness of the presentation, Federal-Mogul reserves the right therefore to adapt, limit or remove certain information without prior notification at its sole discretion. Federal-Mogul does not guarantee the user access to certain information in F-M Campus.
4. User’s duties
4.1 On registration, the user shall provide the necessary information completely and correctly. The user shall notify Federal-Mogul of future changes without delay or shall update such data within F-M Campus on its own.
4.2 The access data shall be considered and handled as confidential information and shall in no case be disclosed to third parties. In case of a loss, access data shall be altered immediately by user or user shall ask Federal-Mogul to alter them, if it is suspected that unauthorized third parties may be in possession of the access data.
4.3 user´s access data shall be used by user only and in no case be disclosed to other individuals.
4.4 The use of F-M Campus by the user may not violate statutory regulations or applicable laws. The user shall refrain in particular from,
unauthorized access to data belonging to Federal-Mogul or third parties,
impairing or overloading the functionality or availability of F-M Campus through misuse or through improper availment,
manipulating, sending or placing data through which the rights of a third party are impaired.
4.5 By means of suitable measures, the user shall ensure that, in using F-M Campus, no harmful programs or parts of program such as viruses, Trojans or worms are spread or inputted.
4.6 Federal-Mogul is entitled to block and/ or delete the user’s access to F-M Campus either temporarily or permanently, user violates its duties as per Sec. 4 of the General Terms and Conditions.
5. F-M Campus’s availability
Federal-Mogul endeavours to make best effort to enable user permanent access to F-M Campus. Operating interruptions or access limitations due to servicing, modifications, extensions or the input of additional content or due to system-immanent disturbances on the Internet or in the case of force majeure are, however, possible. Therefore, Federal-Mogul does not make any representations with regards to availability of F-M Campus.
F-M Campus and the content presented within the framework of F-M Campus are protected by copyright or are subject to other commercial protective rights. The structure and the content of F-M Campus (i.e. in particular text, graphics, audio or video files and similar) may not be fully or partly copied, spread, utilised allowing public access or in any other manner used which extends beyond the customary measure of use of F-M Campus or the content of F-M Campus for the own use without the previous written approval of Federal-Mogul (or that of the appropriate holder of rights). In particular, utilisation of information or content of F-M Campus for the own business purposes is not permitted.
7. Product presentations
7.1 The products presented on the web site shall be presented “as they are” without Federal-Mogul providing any guarantee due to the presentation for the availability or the usability of the product presented for a certain or implied purpose.
7.2 If various products are compared with one another, Federal-Mogul shall in particular not assume any warranty for the fact that all products compared with one another are actually available or – in the case of a functional comparability of the products – that any other properties or capability characteristics of the compared products are also comparable with one another.
8. Liability for damage
8.1 Federal-Mogul shall be liable for damages in accordance with the statutory provisions for personal injury and for damage in accordance with the Product Liability Act.
8.2 Federal-Mogul shall be liable for other damage, inasmuch as nothing else ensues from a warranty assumed by Federal-Mogul, in accordance with the stipulations of the following provisions.
8.2.1 Federal-Mogul is liable in accordance with the statutory provisions for damage which is caused by malicious behaviour and for damage which is caused by intent or gross negligence on the part of Federal-Mogul, its statutory representatives or the senior employees of Federal-Mogul.
8.2.2 Federal-Mogul’s liability for damages is limited to the amount of damage predictable for the typical contract:
- for damage resulting from slightly negligent violation of significant contractual duties or of duties whose fulfilment actually enables correct execution of the contract and in the adherence to which the user can always trust (cardinal duties);
- and for damage which has been caused by simple vicarious agents of Federal-Mogul with intent or grossly negligently.
8.3 Irrespective of the provisions above, any joint guilt of the user shall reduce the amount of any claim for damages – in particular insufficient provision of co-operative services, organisation errors, insufficient data security or violation of other contract duties.
8.4 Otherwise, any liability on the part of Federal-Mogul for damage cause by slight negligence is ruled out.
8.5 For claims of the user, there is a limitation period of one year from the statutory commencement of limitation inasmuch as it does not concern claims due to intent, gross negligence or due to personal injury or in accordance with the Product Liability Act.
9. Final provisions
9.1 Federal-Mogul is entitled at any time to amend and/or supplement these Terms and Conditions with an announcement period of one month by sending an amended version of the Terms and Conditions to the e-mail address stated by the user. If the user does not object to the amended or supplemented conditions within two weeks of receipt, the amended Terms and Conditions shall become effective. The user’s attention is expressly drawn to the right of objection in the amendment notification.
9.2 Amendments and supplements to the Terms and Conditions require written form. This also applies to amendment to this written form clause.
9.3 These Terms and Conditions are subject to the law of the Federal Republic of Germany. Inasmuch as statutorily permissible, Frankfurt/ Main shall be regarded as the place of jurisdiction.
